Overview
whenaminot.com (the "Site") is operated by WhenamInot LLC ("WhenamInot," "we," "us," or "our"), an Arizona business. These Terms of Service ("Terms") apply when you browse the Site or buy from us. By using the Site or placing an order, you agree to these Terms and to the policies they reference: our Refund Policy, Shipping Policy, and Privacy Policy. If you don't agree, please don't use the Site.

Please read Section 15 (Disputes) carefully. It explains how disputes are resolved.

Our store runs on Shopify Inc., which provides the e-commerce platform. Our products are printed and shipped by print-on-demand partners, including Printify and its print providers.

1. Eligibility
You must be at least 18, or the age of majority where you live, to place an order. Younger visitors may browse and shop with a parent's or guardian's involvement and permission.

2. Orders and acceptance
Your order is an offer to buy. We accept it when we start production or ship it. We may refuse or cancel any order, for example for suspected fraud, suspected unauthorized reselling, pricing or listing errors, or when a product is unavailable. If we cancel after you've been charged, we'll refund you in full.

3. Made-to-order products
Each item is printed on demand after you order. Colors on your screen may differ slightly from the printed item, and small variations in print placement, size, and texture are normal with on-demand printing. Sizing information is on each product page; please check it before ordering.

4. Prices and payment
Prices are in US dollars and can change before you order. Applicable taxes and shipping are shown at checkout. You agree to give current, complete, and accurate purchase information and confirm you're authorized to use your chosen payment method.

5. Shipping, returns, and cancellations
Shipping times, delays, and lost-package handling are covered in our Shipping Policy. Misprinted, defective, damaged, or wrong items, refunds, and cancellations are covered in our Refund Policy. Both are part of these Terms.

6. Errors on the Site
We work hard to keep product details, pricing, and availability accurate, but mistakes happen. We may correct errors and update information at any time, and may cancel orders affected by a clear error (with a full refund).

7. Our intellectual property
All designs, artwork, slogans, text, graphics, logos, photos, and the WhenamInot name and brand on the Site and on our products are owned by or licensed to us and protected by copyright, trademark, and other laws. Buying a product gives you the right to own and wear it. It doesn't give you any right to copy, reproduce, resell designs from, or create merchandise from our designs or brand. Please don't use our content without our written permission.

8. Reviews, photos, and other content you share
If you post reviews, photos, comments, or tag us on social media, or send us ideas or feedback ("Your Content"):

• You keep ownership of Your Content. You give us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, edit (for length/format), and share it in connection with our business and marketing, with credit where practical. Please tell us if you'd like a photo taken down.
• You confirm Your Content is honest, is yours (or you have permission to share it, including from anyone pictured), and doesn't violate anyone's rights or the law.
• We may remove content that's unlawful, abusive, hateful, obscene, infringing, spam, or off-topic. We won't remove or penalize honest reviews just because they're negative.
• Feedback and ideas are voluntary, and we may use them without paying you.

Custom and personalized orders. Some products can be personalized with your own name, text, or photo using the personalization tool and live preview on the product page (powered by our print partner Printify). If you submit text, names, images, or other content, you confirm you have the right to use it and that it doesn't infringe anyone's rights or break the law. We may decline or cancel any personalized order at our discretion (for example, content that is infringing, hateful, or obscene, or a photo too low-quality to print well), with a full refund if we cancel. You're responsible for checking spelling, text, photos, and the preview before ordering, and we print what you submit. Personalized items are non-returnable and non-exchangeable. They're covered only if they arrive damaged or misprinted (printed differently from what you submitted and previewed) and you report it with a photo within 30 days of delivery, as described in our Refund Policy.

9. Copyright complaints
If you believe something on our Site infringes your copyright or trademark, email whenaminot@gmail.com with a description of the work, where it appears on our Site, your contact information, and a statement that you have a good-faith belief the use is unauthorized. We'll review it and respond promptly.

10. Acceptable use
Please don't use the Site to break the law; infringe anyone's rights; harass, threaten, or defame anyone; submit false information or impersonate others; upload malware; scrape, crawl, or collect others' information; interfere with the Site's security or operation; or place fraudulent orders. We may suspend or end access for anyone who does.

11. Third-party services and links
The Site uses or links to third-party services (for example, Shopify checkout, payment processors, carriers, and social media). We aren't responsible for third-party sites or services, and their own terms and privacy policies apply.

Our Privacy Policy explains how we handle your personal information.

13. Warranties and disclaimers
We stand behind our products as described in our Refund Policy: if your item arrives misprinted, defective, damaged, or wrong, we'll replace or refund it. Except for that promise and to the extent the law allows, the Site and products are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Site will always be available or error-free. Some states don't allow limits on implied warranties, so these limits may not apply to you.

14. Limitation of liability
To the extent the law allows, WhenamInot and its owners, employees, and partners won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or our products. Our total liability for any claim relating to an order or these Terms is limited to the amount you paid for that order. These limits don't apply to liability that can't be limited by law, such as for gross negligence, willful misconduct, or personal injury caused by our negligence where the law prohibits limitation. Some states don't allow these limits, so they may not apply to you.

15. Disputes, governing law, and venue
Let's talk first. If you have a problem, email us at whenaminot@gmail.com with your name, order number, and what's wrong. You and we agree to try to resolve it informally in good faith for at least 30 days before starting any legal action (this doesn't stop you from disputing a charge with your card issuer).

Governing law. These Terms and any dispute between you and us are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules, and by applicable federal law.

Where disputes are heard. Any dispute not resolved informally will be heard in the state or federal courts located in Maricopa County, Arizona, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court where eligible, including in the county where you live. Nothing in these Terms requires arbitration or limits any right you have under applicable consumer protection law.

16. Indemnification
To the extent the law allows, you agree to cover our reasonable losses and costs (including reasonable attorneys' fees) from third-party claims arising from your violation of these Terms, your misuse of the Site, or Your Content.

17. Changes to these Terms
We may update these Terms from time to time and will change the "Last updated" date above. Changes apply going forward and won't affect orders placed before the change.

18. General
If any part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and us about the Site and your purchases. You may not transfer your rights under these Terms. We may transfer ours, for example in a sale of the business. Section headings are for convenience only.
